CRYSTAL SANDS RENTAL AGREEMENT
Guests must review, sign and return the following CRYSTAL SANDS RENTAL AGREEMENT within 24 hours of making their reservation in order to be considered confirmed. All parties agree to the following conditions:
ARRIVALS: Check-in time is after 3:00 PM
CHECK-IN INSTRUCTIONS: Seven days prior to your arrival, you will receive an email with codes and instructions regarding how to access your unit. It is not necessary to check in at our office until after you have settled in and completed your parking permit application form.
OFFICE HOURS: 8:30 AM to 4:30 PM Monday through Friday. 8 AM to 4 PM Saturday. Closed Sunday.
PARKING: Each unit has 1 assigned spot with 1 vehicle parking pass per vacation rental. Tower renters, please utilize your assigned carport parking spot, and Villa renters, please utilize the garage parking. No boats, motorcycles, golf carts, oversized or lifted trucks, RV’s, personal watercraft or any and all trailers are permitted to park on the premises. Vehicles are subject to parking in the appropriately labeled spots, per the HOA rules & regulations. Any unauthorized vehicles shall be removed or towed at the Guest(s) expense. Should a Guest need an additional parking pass one may be issued, if available, by the Crystal Sands office.
COMMUNITY NOTES: Please note that Crystal Sands is a smoke-free, family-friendly community. Disruptive behavior including loud music, profane language, littering, not maintaining the common spaces (E.G. pools, walkways, beach, parking areas, elevators, lobby, grill area, and restrooms), and any other behavior that would disrupt other guests is strictly prohibited. Any guest not being considerate of others will be asked to comply with our community standards, and in some cases may experience eviction from the property with forfeiture of any monies paid.
MAXIMUM OCCUPANCY: Guest agrees to keep the maximum number of people occupying the premises at/or under the maximum number of persons allowable. Guests of guests are strictly prohibited unless prior office approval is granted. Anyone not registered as a guest may be asked to leave the premises. Any changes required to the number of registered guests must be made in advance by contacting the rental office.
DEPARTURES: Check-out time is 10:00 AM. If you anticipate departing outside of office hours please return the welcome envelope packet, along with wristbands, keyfobs, and parking pass through the mail slot behind the front office. Failure to return your parking pass will result in a $30 deduction from your security deposit, and $50 for any fob not returned prior to departure.
RESERVATION/ PAYMENT: A 25% deposit of the total of all rental fees and taxes is due at the time of reservation to confirm booking. This agreement must be executed and returned at the time reservation is placed. The balance is due 60 days prior to arrival. If the above is not followed, Management reserves the right to cancel said reservation. A 5% Admin Fee will be assessed for each reservation and is non-refundable. A cleaning fee is charged for cleaning at departure. No daily cleans are included in the fee. If Tenant provides management written notice of cancellation on or before ninety (60) days prior to the date of commencement of said rental, any monies paid over the booking fee will be refunded to tenant.
VACATION RENTAL DAMAGE PROTECTION: As part of your reservation, you may purchase Vacation Rental Damage Protection to cover accidental damage to the rental unit during your stay. Damage must be disclosed to management prior to checkout. If purchased, the Plan will pay a maximum benefit of $3,000. Any damage that exceeds $3,000 or is not covered under the Plan will be charged to the credit card on file. Vacation Rental Damage Protection can be purchased up to, and including at, check-in. Certain terms and conditions apply. By submitting payment for this plan, you authorize and request Customized Services Administrators, Inc. d/b/a Generali Global Assistance & Insurance Services to pay directlyCrystal Sands Owners Association, Inc.any amount payable under the terms and conditions of the Vacation Rental Damage Protection Plan. REFUNDABLE DAMAGE DEPOSIT: If you do not wish to purchase the Vacation Rental Damage Protection you may add $1,000 for a damage deposit that will need to be paid in full with final booking payment. If not purchasing the Vacation Rental Damage Protection, the refundable damage deposit of $1,000 shall be held by the Agent to compensate the Owner for (a) unpaid rent; (b) damage or loss of furnishings and equipment within the premises; (c) other services provided by the Agent or its assignees and/or to compensate the Condominium Association for damage to the condominium property; (d) extra cleaning over three (3) hours or $40 per laundry load (f) excessive soil to carpets; (g) paint touch up due to damaged or marked walls. Within sixty (60) days after termination of this Agreement, Agent shall either return the Refundable Damage Deposit to the Guest or make a claim upon said deposit in accordance with Florida law. Garbage left in unit will incur $25 fee per bag, which will be deducted from the security deposit or charged to credit card on file.
TERMS OF CANCELLATION: All cancellations will result in loss of the Admin Fee. Any cancellation 90 days prior to the reservation check in date will result in no additional penalties. However, cancelling within 90 days, of check in date guest will forfeit the Admin Fee plus the 25% deposit. No Refund within 60 days of check in. No refunds for early departures, or late arrivals. Crystal Sands strongly encourages the purchase of Travel Protection in the event of unforeseen circumstances.
TRAVEL PROTECTION: Travel protection has been made available with your reservation. The Plan includes coverage for the loss of your prepaid, non-refundable trip costs if your trip is canceled or interrupted due to certain unforeseeable events. We offer travel protection as a way for you to help protect yourself and your trip investment. Outstanding reservation costs are not eligible for reimbursement at the time of cancellation and the cost of the Plan is not eligible for a full refund outside of the Plan’s free look period. FORCE MAJEURE: Crystal Sands will not be held liable for or issue refunds for circumstances beyond its control. This includes but is not limited to inclement weather, hurricanes, red tide, fire, pandemics, and any other acts of nature; or state, county, or municipal mandated closures or projects. If an evacuation order is put in place, any belongings not removed from the unit, such as groceries and/or luggage, are not Crystal Sands’ responsibility. In certain circumstances your rental monies may be retained by Crystal Sands for use toward a future stay within a specified time period, however, the full amount will be retained even if the stay costs less, and will be forfeited if a booking opportunity is unavailable for any reason. Crystal Sands encourages the purchase of travel insurance.
CONSTRUCTION: Construction within Crystal Sands is permitted during the dates of May 1 through December 15, with the exception of weekends, and national holidays. During this timeline, Crystal Sands and its individual owners reserve the right to have ongoing construction during the hours of 9 AM to 5 PM. Crystal Sands shall not be held responsible for providing any advanced notification, alternative accommodations, or financial compensation to Guest(s), should construction negatively impact their stay.
FINAL PAYMENT: The amount as stated are due as calculated and subject to possible updates if the agreement is modified and/or changed after the time of booking.
ADMIN FEE: The admin fee is 5% and is non-refundable.
SUBSTITUTION OF ACCOMMODATIONS: In certain circumstances beyond our control, (i.e. fire, hurricane, sale of unit, etc.) your confirmed property may become unavailable. Crystal Sands reserves the right to substitute your accommodation, and we will do our best to relocate guests to a comparable unit. We cannot guarantee the confirmed rate in these instances. Any rate increase is the Guests financial responsibility. Although we will do everything possible to create a pleasant vacation experience, neither Crystal Sands, nor the Owner(s) are liable for damages or inconvenience in this rare and unusual circumstance.
CONDITIONS OF PREMISES: Any cleaning problems should be reported in writing within 48 hours of arrival, excluding weekends and holidays. Also, any damage to the unit and/or furnishings must be reported in writing within that same period previously mentioned. Failure to report dissatisfaction with cleaning or damages to unit will result in responsibility of the Guest. The Agent agrees that upon notification by you of any appliance malfunction Crystal Sands shall have 24 hours to make every reasonable effort to have such item promptly repaired in accordance with the property owner(s) direction or move you to a unit of equal value with an operable appliance.
INTERNET SERVICE: In no way shall Crystal Sands be held responsible for cable and/or internet maintenance or delay in service, which is the responsibility of the service provider of each individual unit. Crystal Sands has no control or authority to guarantee connection for a specific time period, nor shall be held responsible for interrupted service.
FURNISHINGS: While this residence conforms to the minimum furnishing requirements of Crystal Sands, all residences are owned, decorated, and furnished by the individual owner. Neither Crystal Sands nor the Owner shall be responsible for providing additional furnishings or equipment not available and not presently existing in the unit at the time the reservation is made.
POOLS: The community pools are under the ownership of the Association and maintained by such. Crystal Sands cannot be held liable for conditions outside our control. All children under the age of 12 must always be accompanied by an adult.
OUTDOOR GRILLS: Use of personal outdoor grills (electric, gas, charcoal) is prohibited on Crystal Sands property. Two gas grills are provided for residents use near the base of the glass elevator.
TENANCY APPROVAL AND COMPLETE COMPLIANCE WITH CONDOMINIUM REGULATIONS: The Rental Agreement and Tenant’s right of occupancy shall be subject to the approval of the Tenant by Crystal Sands Condominium Association, Inc., a Florida corporation. The Tenant’s financial ability, character, and likely compatibility with other occupants of Crystal Sands Condominium shall be considered. Tenant agrees to be bound by all terms and conditions of the Declaration of Condominium governing the Premises and by any rules and regulations heretofore or hereafter adopted by the Association, with the following being of exceptional importance: (a) NO PETS; discovery of a pet on the premises or in the rental unit will automatically result in forfeiting the $500 damage deposit; (b) Tenant may not sublet the Premises nor assign this Agreement; (c) garage doors should be kept closed when not in use; (d) all trash must be bagged and sealed and disposed of properly; (e) incontinent persons, including infants and other children who are not potty trained, are required to wear a swim diaper; (f) no floats or rafts are permitted in the pools; (g) hover-boards, skateboards, in- line skates and roller skates are not permitted to be used on property; (h) Any infraction of the provisions or restrictions set forth in the Condominium Documents/contract/or rules, by the Tenant or their family, guest or invitees shall be deemed a breach of the Lease and Association, with or without the participation of the Landlord, or the Landlord alone shall have the option to terminate the Lease.
FINES AND PENALTIES: Guests will be responsible for any fines, penalties, or citations assessed, either at the time of the incident or after departure, to them individually, to the property, or to Crystal Sands during their time of occupancy, including but not limited to noise and parking, trash removal, and excessive cleaning.
KEY FOBS/PARKING PASSES: All fobs, passes and wristbands that have been provided to the Guest must be returned to the office upon departure. If Guest fails to return these items, a $50.00 lost and/or retrieval fee per item will be charged to the credit card on file.
VALUABLES: Management or Owner is not responsible for the loss of valuables.
PETS: Pets are not allowed. Any breach of this policy will result in termination of this agreement including possible eviction from the property and forfeiture of security deposit.
RESIDENCE ENTRY: Crystal Sands, or its assigns, may enter residence during regular business hours for the normal management/maintenance of residence. The Crystal Sands office will attempt to give guests advance notice of scheduled maintenance and/or appointments, but in the case of an emergency, Crystal Sands reserves the right to enter the unit at any time.
AGE REQUIREMENT: The individual making the reservation with Crystal Sands, must be 25 years of age. Under 25 years of age are prohibited unless accompanied by a parent or legal guardian.
LIMITATION OF LIABILITY/HOLD HARMLESS AND INDEMNITY: The Association shall not be liable to the Tenant or Tenant’s family, agents, guests, or invitees for damage to persons or property caused by other residents or other persons. Association does not warrant security of the property, and is not responsible for the safety of Tenant, or other unit occupants, nor their property. Tenant agrees to indemnify and hold Association harmless from and against any claims for damages to person or property arising from Tenant’s use of the premises, or from any activity or work performed to be suffered by Tenant in or about premises. Association shall not be liable for personal injury, or damages to Tenant’s personal property from theft, vandalism, fire, water, rainstorms, smoke, explosions, sonic booms, riots, or other causes whatsoever unless it is established that Association has been negligent in maintenance of commons elements which are the responsibility of the Association, and which negligence in the proximate cause of the damage.
TERMINATION OF RENTAL: If the Tenant violates any of the conditions/restrictions of this Agreement, Tenant forfeits all monies and Agent may terminate this Agreement, which upon notice of such termination, Tenant shall vacate the Premises immediately. Crystal Sands Condominium Association, Inc., reserves the Right to Evict where Tenant refuses to comply with Association covenants or rules and regulations. Any infraction of the provisions or restrictions set forth in this agreement, all applicable rules and the governing documents of the Association, by the Tenant and/or their family, guest or invitees shall be deemed a breach of the Lease and Association, with or without participation of the Landlord, shall have the option to terminate the Lease. This provision does not prohibit the Owner from directly pursuing the termination of the Lease at their discretion.
WAIVER OF TERMS: No waiver or any breach of any of the terms of this agreement shall be permitted.
GOVERNING LAW: This agreement shall be governed and enforced according to the laws of the State of Florida. The prevailing party in any lawsuit to enforce any provisions of this agreement shall be entitled to an award of attorney(s) fees, costs and expenses for mediation, arbitration and trial or appellate proceedings within the Sarasota Court System.
SMOKING: Smoking is prohibited in vacation rentals, lanais, walkways and Crystal Sands private beach. If any evidence is found inside/outside the vacation rental, forfeiture of security deposit will ensue.
ENTIRE AGREEMENT: This agreement contains the entire agreement of the parties. It may not be changed orally, but only by an agreement in writing signed by the party against whom enforcement of any waiver, change, modification, extension, or discharge is sought. Guest cannot assign or transfer this agreement. By signing below, I agree to the terms and conditions stated in this rental agreement above. I have read my rights and obligations and agree to abide by terms of payment and cancellation policy above.
